This Privacy Policy explains how Sona Audios LLC ("Sona," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information when you access or use the Sona website, apply or audition to become a Sona creator, join our mailing list, communicate with us, or use the Sona mobile application and other products, features, and services that we make available (collectively, the "Services").

Sona is currently in development. Certain features described in this Privacy Policy relate to features we anticipate offering through the Sona platform and may not yet be available.

This Privacy Policy also describes the rights and choices that may be available to you regarding your personal information.

Our Terms of Service govern your use of the Services. Our Community Guidelines & Acceptable Use Policy establish additional rules regarding content and conduct on Sona.

1. Who We Are and When This Policy Applies

Sona Audios LLC operates Sona and is responsible for the personal information described in this Privacy Policy, except where otherwise stated.

This Privacy Policy applies when you:

  • Visit or interact with the Sona website;

  • Apply, audition, or submit materials to become a Sona creator;

  • Join a Sona mailing list or request updates;

  • Communicate with Sona;

  • Participate in creator programs, opportunities, promotions, or other Sona initiatives; or

  • Access or use the Sona mobile application, creator features, community features, customer support, or other Services that link to or reference this Privacy Policy.

Sona is currently building its platform and creator community ahead of launch. As the Services develop, additional features and methods of collecting or processing information may become available.

This Privacy Policy does not apply to third-party websites, applications, services, or platforms that may be accessible through or integrated with Sona and that maintain their own privacy policies.

2. Information We Collect

The information we collect depends on how you interact with Sona, the features you access, and the information you choose to provide.

A. Website and Contact Information

When you visit our website, join our mailing list, contact us, submit a form, or otherwise communicate with Sona, we may collect information such as:

  • Name;

  • Email address;

  • Information submitted through website forms;

  • Marketing and communication preferences;

  • Communications you send to Sona;

  • Information you voluntarily provide when requesting information, support, or updates; and

  • Technical and usage information described elsewhere in this Privacy Policy.

If you join our mailing list, we may use your email address to send Sona launch updates, creator news, announcements, and other communications consistent with the choices you make when subscribing.

You may unsubscribe from promotional emails at any time by using the unsubscribe mechanism included in those communications.

B. Creator Application and Audition Information

If you apply, audition, or express interest in becoming a Sona creator or working with Sona, we may collect information such as:

  • Name and contact information;

  • Professional, stage, or creator name;

  • Confirmation that you are at least 18 years old;

  • Creator role or area of expertise;

  • Creator application responses;

  • Audio auditions, recordings, scripts, portfolios, artwork, design samples, or other creative materials you submit;

  • Biography and professional information;

  • Social media accounts, websites, portfolios, or other links you provide;

  • Information regarding your experience, interests, skills, content preferences, and availability;

  • Information regarding whether you are interested in creating SFW content, NSFW content, or both;

  • Communications between you and Sona regarding your application, audition, or potential creator relationship;

  • Creator agreements and related records if you are selected to work with Sona; and

  • Information relating to creator programs, promotions, contests, collaborations, or opportunities.

 

Submitting an application or audition does not guarantee selection, employment, engagement, compensation, or any particular opportunity with Sona.

If you become a Sona creator, we may also collect information reasonably necessary to administer that relationship, including payment or payout information, tax information where required, contractual records, and related business information.

C. Account and Profile Information

As account functionality becomes available, when you create or maintain a Sona account, we may collect information such as:

  • Name;

  • Email address;

  • Username;

  • Password or authentication credentials;

  • Date of birth or confirmation that you meet Sona's minimum age requirement;

  • Profile image;

  • Biography and profile information;

  • Content and listening preferences;

  • Account settings and preferences; and

  • Account type and creator status.

 

Sona is intended exclusively for adults. Users and creators must be at least 18 years old to access or participate in Sona where required by our Services and policies.

D. Payment and Transaction Information

As paid features become available, if you purchase a subscription, paid content, send a tip, purchase custom content, or use another paid feature offered by Sona, payments may be processed by third-party payment processors, app marketplaces, or other payment providers.

Sona does not directly store complete payment-card numbers when payments are processed by these providers.

We may receive and maintain transaction-related information such as:

  • Purchase and subscription history;

  • Transaction identifiers;

  • Subscription status;

  • Amounts paid;

  • Payment status;

  • Refunds and chargebacks;

  • Creator earnings and payouts; and

  • Information necessary to administer transactions and resolve payment issues.

 

Creators who receive payments may be required to provide additional identity, payment, banking, or tax information to Sona or its payment providers as necessary to process payouts and comply with applicable law.

E. Content You Provide

 

Depending on the features available and how you interact with Sona, we may collect content and information that you submit, upload, publish, transmit, or otherwise make available, including:

  • Audio recordings;

  • Auditions and voice samples;

  • Scripts;

  • Artwork and visual materials;

  • Creator materials;

  • Profile content;

  • Comments;

  • Reviews or reactions;

  • Custom content requests; and

  • Other user-generated or creator-generated content.

 

Content you choose to publish publicly or share with other users may be visible to those users or to the public depending on the applicable feature and your settings.

Creator application and audition materials are not considered publicly published merely because they are submitted to Sona through an application or audition process.

F. Communications and Community Interactions

 

We may collect information you provide when you communicate or interact with Sona, creators, or other users through features we make available. This may include:

  • Communications with Sona;

  • Customer support inquiries;

  • Comments and community interactions;

  • Communications with creators or other users;

  • Reports and complaints;

  • Appeals;

  • Responses to moderation inquiries; and

  • Information or materials you voluntarily submit in connection with reports, disputes, or investigations.

 

The information collected through these interactions will depend on the features available and the information you choose to provide.

G. Usage and Device Information

 

When you access or use the Sona website, application, or other Services, we and service providers supporting our Services may automatically collect certain technical and usage information, such as:

  • IP address;

  • Device type;

  • Operating system;

  • Browser type;

  • App version;

  • Device or app identifiers;

  • Language and time zone;

  • Pages and screens viewed;

  • Features accessed;

  • Search activity within the Services;

  • Content viewed, played, saved, liked, followed, or otherwise interacted with;

  • Interactions with creators and other users;

  • Dates and times of access;

  • Referring pages or sources;

  • Crash reports;

  • Diagnostic information;

  • Performance information; and

  • Approximate location derived from information such as your IP address.

 

The specific information collected may vary depending on the Services, features, and technologies in use.

H. Cookies and Similar Technologies

We and service providers that support our Services may use cookies, software development kits ("SDKs"), pixels, local storage, and similar technologies, where applicable, to:

  • Provide website and platform functionality;

  • Authenticate users and maintain sessions;

  • Remember preferences;

  • Understand how the Services are used;

  • Measure and improve performance;

  • Diagnose technical issues;

  • Prevent fraud and abuse;

  • Form and application providers;

  • Email and communications providers;

  • Payment processors;

  • App marketplaces;

  • Authentication providers;

  • Analytics providers;

  • Cloud hosting and technology providers;

  • Marketing providers;

  • Social media platforms; and

  • Other users when they interact with you or submit reports through the Services.

 

The information we receive depends on the third party, the Services being provided, your settings, and any permissions you provide.

3. Sensitive Personal Information and Adult Content Privacy

 

Sona is an adult-oriented platform intended exclusively for individuals 18 years of age or older. Sona may include both SFW and NSFW content.

We recognize that information about how users interact with adult or intimate content may be particularly private.

Depending on the Services and features you use, Sona may process information relating to your content preferences, searches, listening activity, subscriptions, or interactions with content and creators.

We use this information only for purposes consistent with this Privacy Policy, such as providing and personalizing the Services, maintaining account functionality, improving the user experience, protecting the safety and integrity of Sona, and complying with applicable law.

Where applicable law provides additional protections or choices concerning sensitive personal information, Sona will handle such information in accordance with those requirements.

4. How We Use Personal Information

 

We may use personal information to:

  • Operate, maintain, develop, and improve Sona and the Services;

  • Operate the Sona website;

  • Review creator applications, auditions, portfolios, and other submissions;

  • Evaluate potential creator relationships and opportunities;

  • Communicate with applicants and creators regarding applications, auditions, collaborations, contracts, and opportunities;

  • Build and administer Sona's creator community and programs;

  • Create, authenticate, secure, and manage accounts as account functionality becomes available;

  • Confirm eligibility to use age-restricted Services or participate as a creator;

  • Provide and personalize content, features, search results, and recommendations;

  • Process subscriptions, purchases, tips, custom-content transactions, creator payouts, refunds, and other transactions as those features become available;

  • Facilitate interactions between users and creators;

  • Provide customer service and respond to inquiries;

  • Send account, transaction, security, and administrative communications;

  • Send Sona news, launch information, creator updates, announcements, and other promotional or marketing communications where permitted by law and consistent with your choices;

  • Understand how users interact with the Sona website and Services;

  • Develop and improve features, content, products, and user experiences;

  • Diagnose technical issues and maintain performance;

  • Detect, investigate, prevent, and address fraud, abuse, security incidents, prohibited activity, and violations of our policies;

  • Review reports, complaints, disputes, and appeals;

  • Enforce our Terms of Service, Community Guidelines, creator agreements, and other applicable policies or agreements;

  • Protect the rights, safety, privacy, property, and integrity of Sona, our users, creators, and others;

  • Verify and respond to copyright or intellectual property claims;

  • Maintain appropriate business, financial, tax, contractual, and transaction records;

  • Comply with applicable legal, regulatory, tax, accounting, and other obligations;

  • Respond to lawful requests from courts, regulators, law enforcement, or other governmental authorities; and

  • Establish, exercise, or defend legal claims.

 

5. Legal Bases for Processing

If you live in a jurisdiction that requires us to identify a legal basis for processing personal information, such as the European Economic Area ("EEA"), United Kingdom, or Switzerland, we may process personal information based on one or more of the following:

Performance of a Contract

We process information when necessary to provide Services you request or perform our contractual obligations to you.

For example, we may process creator information to administer a creator agreement or account and transaction information to provide a subscription or paid feature.

Legitimate Interests

We may process information when reasonably necessary for our legitimate business interests or those of another party, provided those interests are not overridden by applicable privacy rights.

These interests may include developing and operating Sona, reviewing creator applications, communicating with prospective creators, improving our Services, protecting users and creators, maintaining security, preventing fraud and abuse, enforcing our policies, understanding how the Services are used, and supporting our business operations.

Consent

We may process information based on your consent where required or appropriate, including certain marketing communications.

Where processing is based on consent, you may withdraw your consent at any time, subject to applicable law. Withdrawal does not affect processing that occurred before consent was withdrawn.

Legal Obligations

We may process personal information when necessary to comply with applicable laws, regulations, legal processes, tax or accounting requirements, or other legal obligations.

6. How We Disclose Personal Information

We may disclose personal information in the circumstances described below.

A. Service Providers

We may disclose personal information to vendors, contractors, and service providers that help us operate, develop, secure, and support the Services.

Depending on the services and technologies in use, these providers may assist with functions such as:

  • Website hosting and development;

  • Application and form processing;

  • Cloud hosting and infrastructure;

  • Payment processing;

  • Creator payouts;

  • Authentication;

  • Analytics;

  • Email and communications;

  • Customer support;

  • Security and fraud prevention;

  • Software development and technical services; and

  • Data storage and management.

These providers may process personal information as necessary to provide services to Sona and subject to applicable contractual and legal requirements.

As the Services develop, the providers we use may change.

B. Other Users and Creators

As public and community features become available, information you intentionally make public through your profile, published content, comments, creator page, or other public features may be visible to other users or the public.

Where necessary to provide subscriptions, tips, custom content, community features, or other user-to-creator interactions, limited information may also be provided to the applicable creator or user.

We do not intentionally provide creators with a listener's complete payment-card information.

Creator applications, auditions, portfolios, and materials submitted privately to Sona are not made public solely because you submit them through our application or audition process.

C. Legal, Safety, and Enforcement Purposes

We may disclose information when we reasonably believe doing so is necessary to:

  • Comply with applicable law, regulation, subpoena, court order, legal process, or valid governmental request;

  • Investigate or respond to suspected illegal activity;

  • Enforce our Terms of Service, Community Guidelines, creator agreements, or other policies;

  • Detect, investigate, or prevent fraud, security incidents, abuse, or prohibited activity;

  • Protect the rights, privacy, property, or safety of Sona, our users, creators, or others; or

  • Establish, exercise, or defend legal claims.

 

D. Business Transactions

If Sona is involved in a merger, acquisition, financing, restructuring, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.

E. With Your Direction or Consent

We may disclose information to another party when you direct us to do so or otherwise provide consent.

7. Sale, Sharing, Advertising, and Analytics

 

Sona does not sell personal information for money.

We may use service providers and technologies to support analytics, measure performance, understand how our website and Services are used, and support our communications and marketing activities.

Certain privacy laws may define terms such as "sale," "sharing," or "targeted advertising" more broadly than an exchange of personal information for money. If Sona engages in activities that are considered a sale, sharing, or targeted advertising under applicable law, we will provide any notices, choices, or opt-out mechanisms required by law.

8. Data Retention

 

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including operating and developing the Services, reviewing and administering creator applications and relationships, maintaining appropriate business records, complying with legal obligations, resolving disputes, preventing fraud and abuse, enforcing our agreements, and protecting the safety and integrity of Sona.

Retention periods may vary based on:

  • The type and sensitivity of the information;

  • The reason the information was collected;

  • Whether you are an applicant, creator, user, or mailing-list subscriber;

  • How long your account remains active, where applicable;

  • Applicable legal, tax, accounting, or contractual requirements;

  • Fraud, safety, or security considerations; and

  • Whether information is relevant to an ongoing application, creator relationship, report, investigation, dispute, or legal proceeding.

 

Creator applications, auditions, portfolios, and related communications may be retained for a reasonable period to evaluate your application, administer current or potential opportunities, maintain appropriate business records, or consider you for future opportunities, subject to applicable law.

If you would like to request deletion of application or audition information you previously submitted, you may contact us using the information provided in the "Contact Us" section below. Certain information may be retained where permitted or required by law or reasonably necessary for legitimate business, contractual, security, or legal purposes.

Transaction and tax records may need to be retained for legally required periods even after an account or creator relationship ends.

When personal information is no longer reasonably necessary, we will delete, de-identify, or otherwise dispose of it in accordance with applicable requirements.

9. Account and Data Deletion

 

Where account functionality is available, you may request deletion of your Sona account and associated personal information using the account deletion functionality or designated account deletion process made available through the Services.

You may also contact us at hello@sonaaudios.com to request deletion of personal information associated with a creator application, audition, mailing-list subscription, or other interaction with Sona, subject to applicable law.

When applicable information is deleted, Sona will delete or de-identify personal information associated with your request, subject to information we are permitted or required to retain for purposes such as:

  • Legal and regulatory compliance;

  • Tax and accounting requirements;

  • Contractual obligations;

  • Fraud prevention;

  • Security;

  • Dispute resolution;

  • Enforcement of our agreements and policies;

  • Protection of Sona and our users; and

  • Establishing, exercising, or defending legal claims.

 

Information may remain in secure backups for a limited period before being deleted through our normal backup processes.

We may retain aggregated or de-identified information that can no longer reasonably be associated with you.

Where applicable, deletion of your Sona account may not automatically cancel an active subscription purchased through a third-party marketplace or payment provider. You may need to separately cancel the subscription through the provider through which it was purchased.

10. Security

 

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, acquisition, loss, misuse, alteration, or disclosure.

However, no system, network, electronic transmission, or method of storage can be guaranteed to be completely secure. We therefore cannot guarantee the absolute security of personal information.

Where account functionality is available, you are responsible for maintaining the confidentiality of your account credentials and should notify us promptly if you believe your account has been compromised.

11. Your Privacy Rights and Choices

 

Privacy rights vary depending on where you live.

Subject to applicable law, you may have the right to:

  • Request access to personal information we maintain about you;

  • Request correction of inaccurate personal information;

  • Request deletion of personal information;

  • Obtain information regarding how we collect, use, and disclose personal information;

  • Obtain a portable copy of certain personal information;

  • Object to or restrict certain processing;

  • Withdraw consent where processing is based on consent;

  • Opt out of certain marketing communications;

  • Opt out of certain sales, sharing, targeted advertising, or profiling where applicable;

  • Limit certain uses of sensitive personal information where applicable;

  • Appeal certain decisions regarding privacy requests; and

  • Exercise your rights without unlawful discrimination or retaliation.

 

Not all rights apply in every jurisdiction, and certain rights may be subject to exceptions under applicable law.

12. Exercising Your Privacy Rights

Your request should provide sufficient information for us to understand your request and reasonably verify your identity.

We may request additional information when reasonably necessary to verify that the request relates to you. We will use information submitted for verification only for purposes related to processing the request, except as otherwise permitted by law.

We will not require you to provide highly sensitive information, such as a full Social Security number or complete payment-card number, solely to submit a privacy request.

If we cannot reasonably verify your identity or authority to make a request, we may be unable to fulfill some or all of the request.

Where applicable law permits an authorized agent to submit a request on your behalf, we may require appropriate documentation establishing the agent's authority and may separately verify your identity.

We will respond within the timeframe required by applicable law.

If we deny a request in whole or in part, we will provide the information required by applicable law regarding the decision and any available appeal rights.

13. Marketing Communications

If you choose to join our mailing list or otherwise consent to receive marketing communications, Sona may send you launch updates, creator news, announcements, information about Sona, and other promotional communications.

You may opt out of promotional emails at any time by following the unsubscribe instructions contained in those communications.

Even if you opt out of promotional communications, we may continue to send non-promotional messages where applicable relating to your creator application, creator relationship, account, transactions, security, customer support, policy or legal notices, and other administrative matters relating to the Services.

Where Sona uses text messages, push notifications, or other marketing channels in the future, additional consent and opt-out mechanisms may apply.

14. U.S. State Privacy Rights

Residents of certain U.S. states may have additional rights under applicable state privacy laws.

Depending on your state of residence and applicable law, these rights may include:

  • The right to know or confirm whether Sona processes your personal information;

  • The right to access personal information;

  • The right to correct inaccuracies;

  • The right to request deletion;

  • The right to obtain certain personal information in a portable format;

  • The right to opt out of certain sales of personal information;

  • The right to opt out of sharing for cross-context behavioral advertising or targeted advertising;

  • The right to opt out of certain profiling;

  • The right to limit certain uses or disclosures of sensitive personal information;

  • The right to appeal certain privacy decisions; and

  • The right not to receive unlawful discriminatory treatment for exercising privacy rights.

 

California Residents

California residents may have additional rights under the California Consumer Privacy Act, as amended ("CCPA").

The categories of personal information Sona collects, the purposes for which we use that information, and the categories of parties to whom it may be disclosed are described throughout this Privacy Policy.

Subject to applicable law, California residents may have rights to request access, correction, or deletion of personal information and to obtain information concerning certain collection, use, disclosure, sale, or sharing practices.

If Sona engages in activity considered a "sale" or "sharing" of personal information under California law, we will provide the legally required mechanisms for exercising applicable opt-out rights.

California residents also have the right not to receive discriminatory treatment prohibited by law for exercising applicable privacy rights.

15. Privacy Rights for EEA, UK, and Swiss Users

If applicable data protection law in the European Economic Area, United Kingdom, or Switzerland applies to the processing of your personal information, you may have additional rights, including the right to:

Access

Request access to personal information we maintain about you and receive information regarding its processing.

Correction

Request correction of inaccurate or incomplete personal information.

Erasure

Request deletion of personal information in circumstances provided by applicable law.

Restriction

Request restriction of certain processing of your personal information.

Objection

Object to processing based on certain legitimate interests and object at any time to processing for direct marketing.

Data Portability

Receive certain personal information in a structured, commonly used, machine-readable format and, where applicable, request its transfer to another organization.

Withdraw Consent

Withdraw consent at any time where we rely on consent to process personal information. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal.

Complaint

You may have the right to lodge a complaint with the applicable data protection authority in your country or region.

These rights may be subject to conditions and exceptions under applicable law.

16. International Data Transfers

Sona is based in the United States, and personal information collected through the Services may be transferred to, stored in, or processed in the United States or other countries where Sona or its service providers operate.

Those countries may have privacy and data protection laws that differ from those in your country of residence.

Where applicable law requires specific safeguards for international transfers of personal information, Sona will use appropriate legally recognized mechanisms or safeguards for those transfers.

17. Children's Privacy

Sona is intended exclusively for adults and is not directed to individuals under the age of 18.

Individuals under the age of 18 may not apply or audition to become Sona creators or access age-restricted Sona Services.

We do not knowingly permit individuals under 18 to create accounts or otherwise participate in Services restricted to adults.

If we learn that we have collected personal information from an individual under 18 in violation of our age requirements, we will take appropriate steps to delete the information and terminate or restrict the associated account, application, or participation, subject to applicable legal obligations.

18. Third-Party Services and External Links

The Services may contain links to, integrate with, or rely upon third-party websites, applications, form providers, payment processors, app marketplaces, authentication providers, analytics providers, hosting providers, email providers, social networks, or other services.

For example, Sona may use third-party services to host its website, collect creator applications and auditions, deliver communications, process payments, or provide technical infrastructure.

Those third-party services are not controlled by Sona and may collect or process information according to their own privacy policies and practices.

This Privacy Policy does not govern information you provide directly to a third party or information collected independently by third-party services.

We encourage you to review the privacy policies and terms of third-party services you choose to use.

19. Changes to This Privacy Policy

 

We may update this Privacy Policy as Sona develops and launches additional features or to reflect changes to our Services, data practices, technology, legal requirements, or other circumstances.

When we update this Privacy Policy, we will post the revised version and update the "Last Updated" date.

Where required by applicable law, we will provide additional notice before material changes take effect.
